El mercado inmobiliario de Benahavís baja un 35%. ¿Es del todo cierto?

La verdad es que si miramos la información publicada por el Ministerio de Fomento sobre el número de transacciones cerradas en Benahavís durante el segundo trimestre de 2017, el número es ciertamente alarmante con una bajada de un 35% en el número de operaciones cerradas en el último año. ¿Es realmente esta la realidad del mercado o es que los números no están reflejando exactamente lo que esta pasando? Puede haber dos razones: el efecto del Brexit y la venta de nuevas promociones en la zona.

The market in Benahavis goes down 35%. Is that a fact?

Taking a look to the latest information on the transactions closed in Benahavis in the last year, the number is somewhat scary with a reduction of 35% in the number of closings. Is that really the case or the official numbers are not reflecting the reality of the market? Maybe two reasons: again the effects of the Brexit and the sale of new developments in the area.

The truth is that there are 35% less closings at the Land Registry that one year before and that goes from July 2016 to end of June 2017. When talking to some professionals in the real estate business, they refer that the cause maybe that buyers are going for new developments, still many of them under construction, and those sales will not be reflected on the official numbers, that is when they are fully close at Notary, until 2018 or even 2019. On the “good old times”, I mean between 2003 and 2007, 40% of the sales were of new built properties so that may be the case again. That is just an speculation as it is impossible to check as that information is not public but private. However, what is true is that the sale of second hand properties, that is fully reflected on the statistics, did go down 35% and those are not good news for people selling or thinking on selling their properties. Again, with a market loss of that level on the sale of second hand properties, having a competitive price is of the essence to be able to close a sale and it is even more critical now than one year ago.

If the take now a look to the numbers of Marbella, the year on year loss has been a minimum 1,4% that, thinking on the two reasons given for the market in Benahavis is more than reasonable.

¿Quién compra y qué están comprando en la Costa del Sol?

El informe del Colegio de Registradores de de España para el primer trimestre de 2017 aporta unas piezas de información muy interesantes sobre el mercado inmobiliario que me gustaría compartir. Son principalmente sobre operaciones cerradas por parte de extranjeros en España y la provincia de Málaga y la distribución de transacciones entre inmuebles nuevos y de segunda mano para, asimismo, Málaga. Con los datos se han preparado algunos gráficos que se explican por sí mismos.

En cuanto a la distribución entre nuevos y usados, se observa un importante aumento en la venta de nuevas propiedades frente a las de segunda mano, aunque sigue siendo baja, con sólo el 24% de las operaciones.

En relación con las transacciones cerradas por extranjeros, hay un dato relevante que se podía intuir. Los británicos son la única nacionalidad en la que se redujo el número de propiedades que compraron en un 27,2%, especialmente después del voto Brexit, aunque sigue siendo la nacionalidad con un porcentaje más alto, un 14,5%, de las ventas a extranjeros y que aun sigue siendo mayor que el de los franceses, segundos en el ranking, con un 9,6% y un aumento del 35% en el último año. Por otra parte, el resto de nacionalidades registró aumentos en el número de transacciones. Sin embargo, incluso con ese aumento, el porcentaje de transacciones por parte de extranjeros (13,1%) fue un poco menor en el primer trimestre porque el número de españoles comprando también aumentó y en mayor porcentaje.

Who is buying and what are they buying at the Costa del Sol?

The report of the Association of Land Registrars in Spain for the first quarter of 2017 gives some interesting pieces of valuable information about the real estate market that I would like to share. It is mainly about transactions by foreigners in Spain and in the Malaga province and the distribution of transactions between new and second hand properties for the province of Malaga. I have taken the data and prepared some charts that are self explanatory. Regarding the distribution between new and used, it can be seen an important increase in the sale of new properties vs second hand although still low, just 24% of the closings.

In relation to the transactions closed by foreigners, there is nothing that everybody would have guessed. The British are the only nationality that saw the number of closed transactions going down by 27,2% specially after the Brexit vote although still is the nationality with a higher percentage among the foreigners with 14,5% of the closings that is still higher than the French, the second in the ranking, with 9,6 % and a 35 % increase in the last year. Furthermore, the rest of the nationalities saw increases in the number of transactions. However, even with that increase, the percentage of transactions by foreigners (13,1%) went a little bit down in the first quarter because the number of Spaniards buying also increased and in higher percentage.

The real estate market for Benahavis worse in 2016 than in 2015

I am meeting a number of sellers lately telling me that they are thinking on selling their properties because the market is getting better. When asked about where they gather that information, they say on the news. Is it true or is not? If you look at the official numbers on the closed transactions for Benahavis, they do not look that good. In fact, as can be seen on the attached chart, the number of transactions in 2016 was lower than that of 2015 and also than 2014. In percentage, there are 16% less transactions closed in 2016 than in 2015. The first quarter of 2017 does also not look promising as the number of closed transactions closed goes down an additional 11% when compared to the first quarter of 2016.

That means that there is less demand now than two years ago and last year. If we add this parameter to what I commented in my last newsletter on the increasing inventory of properties for sale, the news are not that good for someone thinking on selling: less demand and more offer with stable prices on the lowest. It is true that in these numbers you can not see the reservations closed in new developments that are still under construction, and in Benahavis, will not be counted until next year but those will not greatly affect the general numbers of second house sales.

On the other hand, and if we take a look to the numbers in Marbella, the situation was quite similar in 2016 but with a minor reduction of 9%: less transactions, more inventory and flat prices. However, in the case of Marbella the number of transactions in the first quarter of 2017 showed a 7% increase versus the same quarter of 2016.

The information on the news about a better market is correct for some areas of Spain and even in the province of Malaga but not for the local market of Benahavis. Probably because the British market, with buyers in the area with budgets on top of 200.000 €, has been highly affected by the Brexit vote and the uncertainties that are around the negotiations between UK and the European Union. I am of the opinion that time will put thing back in place but, meanwhile, the truth is that the facts show that our local market is being affected by that vote.

He tenido recientemente unas cuantas conversaciones con personas que me comentaban que estaban pensando en vender sus propiedades porque el Mercado estaba mejorando y cuando les preguntaba que de dónde habían obtenido esa información, me decían que de las noticias. ¿Es esto cierto o no? Si consultamos las cifras oficiales de las transacciones cerradas en Benahavís, no parecen tan buenas. De hecho, como puede verse en el gráfico más abajo, el número de transacciones en 2016 fue inferior al de 2015 e incluso al de 2014. En porcentajes, hay un 16% menos de transacciones cerradas en 2016 que en 2015. El primer trimestre del 2017 tampoco parece muy alentador, ya que el número de transacciones cerradas baja un 11% más comparado con el primer trimestre de 2016.

Esto significa que ahora la demanda es menor que hace dos años e incluso más baja que el año pasado. Si añadimos este parámetro a lo que comenté en mi último boletín sobre el inventario creciente de propiedades en venta, las noticias no son tan buenas para alguien que está pensando en vender: menos demanda y más oferta con precios que siguen sin subir. Es verdad que en las cifras no se reflejan las reservas sobre propiedades en construcción y, en Benahavís, no se reflejarán hasta el año que viene, pero esto no afecta a los vendedores de segunda mano.

Por otro lado, si consultamos el número de transacciones cerradas en Marbella, la situación fue bastante similar en 2016, pero con una bajada menor de un 9%: menos transacciones, más inventario y precios estables. Sin embargo, en el caso de Marbella el número de transacciones durante el primer trimestre de 2017 apuntó un crecimiento del 7% en comparación con el mismo trimestre de 2016.

Las noticias sobre la mejora del Mercado son correctas para algunas zonas de España e incluso en la provincial de Málaga, pero no para el Mercado local de Benahavís. Probablemente porque el Mercado británico en este área, con compradores con un presupuesto máximo de 200.000 €, se ha visto muy afectado por el Brexit y las incertidumbres que existen en torno a las negociaciones entre el Reino Unido y la Unión Europea. Soy de la opinión de que el tiempo pondrá las cosas en su sitio pero mientras, tanto los hechos demuestran que nuestro Mercado local se está viendo afectado  por el Brexit y sus implicaciones.

El inventario de propiedades para la venta sigue subiendo

Añadido a la reducción del número de transacciones que se reportaron el año
pasado en Marbella y Benahavís en comparación con 2015, el inventario de propiedades
para la venta sigue subiendo. Tratando de buscar una explicación para eso, lo
atribuiré a tres razones principales: los bancos, o fondos de inversión que compraron
propiedades de esos bancos, están poniendo en el mercado complejos enteros que
quedaron bloqueados con la crisis después de prepararlos para la venta; debido a que
hay un sentimiento general de que el mercado esta mejor, muchos propietarios están
poniendo sus propiedades en el mercado después de esperar unos cuantos años pensando
que la crisis ya se ha acabado y, simpemente, porque la reducción en el número de transacciones en 2016 ha hecho que se absorban menos propiedades. Por lo tanto, como se puede ver en el gráfico de abajo, la situación no es a favor de los vendedores.

Ese gráfico muestra el número de meses necesarios para vender el inventario completo. Según las estadísticas, si el número de meses necesarios para vender, es inferior a 7, es un Mercado de vendedores. Si es superior a 7, es un mercado de compradores. Como puede verse en el mencionado gráfico, nuestro índice está alrededor de 15, incrementándose en Marbella, así que todavía sigue siendo un mercado para el comprador. Ambos números analizados en este artículo muestran que el mercado en lugar de ir en favor de los vendedores, va en su contra. Eso puede explicar, una vez más, basándonos en mis últimos comentarios acerca de la impresión que recibimos al trabajar con los compradores, que no tienen ningún sentido de urgencia en la compra. No hay temor de perder una propiedad.

The Inventory of Properties for sale keeps on rising

Added to the reduction on the number of transactions that were reported last year in Marbella & Benahavis compared to 2015, the inventory of properties for sale keeps on going up. Trying to look for an explanation for that, I will attribute it to three main reasons: the banks, or investment funds that bought properties from those banks, are putting complete developments that were stocked during the crisis into the market after preparing them for the sale; since there is a general positive sense in the market due to the increase number of transactions, more owners are putting their properties in the market after, waiting for a number of years, thinking that the crisis is over; and the fact the number of closed transactions went down in 2015.

Therefore, as it can be seen on the below chart, the situation is not in favor of the sellers. That chart shows the number of months required to sell the complete inventory.  According to the statistics, if the number of months required to sell the complete housing inventory is less than 7, it is a seller’s market. If it is higher than 7, it is a buyer’s market.

On the graph it can be seen that our index is around 15 and increasing for Marbella so it is still now a buyer’s market. Both numbers analyzed in this article show that the market instead of going in favor of the sellers is again going against them. That may explain, again, my latest comments about the impression we receive when working with buyers, they do not have any sense of urgency when buying. There is no fear of loosing a property.

New information was released last month that confirms the impressions of those working in the real estate market of Marbella and Benahavis that is that the market slowed down last year. We still have to see the data for the last quarter that will be published in March but I do not expect a recuperation at the end of the year that showed also little activity.

As it can be seen on the attached chart, all quarters were worst than the precedent one for a total decrease in the number of Closed Transactions of almost 10% for a one year period. The situation in Benahavis is even worse with a decrease of almost 20% over one year period and 34% when compared with the precedent quarter. The question is: Why are we hearing on TV that the market is recovering? That is a reality in fact for most of the Costa del Sol but not in Marbella & Benahavis. The fact that 2016 was year full of uncertainties with the Brexit vote, the Spanish Elections and the canceling of the Planning Permission for Marbella did not help the local market at all. However, that should also affect the market in Torremolinos and Benalmadena and did not. 

If we take a look to the distribution of the Closed Transactions as a function of the selling price, we may be able to see that most of the transactions in the province of Malaga, almost 64%, were closed below 150.000 € with only 0,4% on top of the one million figure. That means that most of the buyers are coming with budgets below 150.000 € and that product hardly exists in Marbella & Benahavis. That may be the key of the decrease vs the market in Malaga, Benalmadena, Torremolinos and Fuengirola.

¿Cuál es el proceso habitual de compra de una propiedad en España (I)?

El proceso para comprar una propiedad en España es bastante sencillo y, aunque puede variar, incluso mucho, para casos especiales, la idea de estos artículos es establecer el caso general. El punto de partida sería cuando el precio y las condiciones adicionales (periodos de tiempo, muebles, etc.) para una compra se acuerdan entre las partes. El proceso incluye la reserva (o poner la propiedad fuera del mercado, mientras se lleva a cabo la comprobación de documentación), el Contrato Privado de Compraventa, la Escritura de Compraventa en presencia de un Notario y el registro de la propiedad a nombre del comprador. Aunque los pasos son simples, voy a dedicar un artículo a cada uno de aquellos para tratar de cubrir tantos aspectos generales como sea posible. 

1.– RESERVA DE LA PROPIEDAD

 Normalmente, el primer paso es quitar la propiedad del mercado con un depósito mientras se comprueba la documentación. Dicho depósito se encuentra en la mayoría de los casos en poder de la inmobiliaria o del abogado que representa al vendedor en una cuenta de depósito de clientes. En general, el documento establece que si la situación jurídica y física de la propiedad es la correcta para la venta, los compradores deben proceder a la siguiente etapa o perderán ese depósito. Si durante elproceso de comprobación de documentación aparece algo, desde un punto legal o físico, que haga inviable la venta, la parte que mantenga el depósito deberá devolverlo a los compradores.

 a) ¿Qué documentación se comprueba durante el proceso de la reserva?:

 - Nota Simple: se detalla quien es el dueño, la descripción de la propiedady las cargas sobre la propiedad.

- La propiedad puede estar a nombre de más un individuo o de una empresa, por lo que en el primer caso, todos los propietarios tienen que estar de acuerdo con la venta y firmar la documentación apropiada o en el segundo caso un representante de la empresa debe ser el que firme todos los documentos para la venta.

- La descripción de la propiedad en la Nota Simple (incluyendo y no limitada a la dirección, tamaños y lindes) tiene que coincidir con lo que se le ha dicho al comprador que iba a comprar.

- Las propiedades se venden, en general, libres de carga. Si aparece cualquier gravamen en la nota simple, el vendedor es responsable de eliminar la misma del Registro de la Propiedad antes de la transmisión (puede incluir hipotecas, embargos, cargas urbanísticas, etc.).

- Licencias urbanísticas: que deben ser revisadas, especialmente en Marbella, donde la situación urbanística no está totalmente clara, para ver si la propiedad cumple con la normativa urbanística de la zona/urbanización /complejo. Esto no es un paso fácil y debe ser tratado por un experto en estos temas como un abogado, un arquitecto o un agente inmobiliario con experiencia.

- Pago de los impuestos (principalmente IBI y basura) y los gastos de comunidad: los gastos se cargan a la propiedad y se debe comprobar que están al día.

 b) Una revisión física por un técnico experto o un agente inmobiliario con experiencia para establecer si la propiedad tiene algún defecto que puede o no ser corregido, o compensado. En caso de defectos graves, como daños estructurales serios, el acuerdo se romperá.

¿Qué está pasando con el precio de la vivienda en Marbella?

La información publicada recientemente por el Ministerio de la Vivienda sobre el índice de precios en el segundo trimestre de 2016 para Marbella muestra la misma situación que hemos estado experimentando en, al menos, los últimos tres años, que es que los precios no están mostrando una verdadera tendencia al alza. Sinceramente pensé que íbamos a ver aumentos pero no es el caso de Marbella. En Estepona, las cosas son un poco diferentes y se puede observarun ligero aumento en la curva.

Para contrastar la información facilitada por el Ministerio, he comprobado el índice de precios publicado por uno de los mejores portales inmobiliarios en España, Fotocasa. Lo que podemos ver es que, aunque los valores son diferentes, lo cual es normal debido a que el portal funciona con propiedades de "en venta", la tendencia es aproximadamente la misma. He incluido tablas de Fotocasa de Marbella Este, la Milla de Oro y Nueva Andalucía. En Marbella Este los precios son más bajos que al final del año pasado, en la Milla de Oro los precios subieron un poco al final de 2015, pero volvieron a bajar en 2016 y en Nueva Andalucía subieron a finales de 2015 y se mantienen con una tendencia hacia abajo durante el año 2016. Por lo tanto, la misma tendencia que los datos oficiales: ligeros aumentos en el comienzo de este año y desde entonces se mantienen. Sinceramente, aunque pensé que íbamos a ver aumentos en los precios, creo que era más un deseo para la normalización que una realidad ya que todavía puedo sentir que el mercado sigue estando lento. Lo que es cierto es que estamos viendo actividad por los promotores y compradores institucionales en busca de terrenos para construir y oportunidades en el mercado, pero el flujo de compradores finales sigue siendo lento.

How is the standard purchase process of a property in Spain (I)?

The process to buy a property in Spain is quite straight forward and, although it may vary, even a lot, for special cases, the idea of these articles is to establish the general case. The starting point would be when the price and additional conditions (time frames, furniture, etc.) for a purchase are agreed between the parties. The process includes the reservation (or taking the property out of the market while the due diligence is performed), a Private Purchase Contract, the signature of a Public Purchase Deed in front of a Notary and the Land Registration of the property on the buyers name. Although the steps are simple, I am going to dedicate an article to each one of those to try to cover as many general aspects as possible.

1.– RESERVATION OF THE PROPERTY

Usually the first step is to take the property off the market with a deposit while the due diligence on it is performed. That deposit is in most of the cases held by the real estate agency or the lawyer representing the seller on a escrow account. In general, the document establishes that if the legal and physical situation of the property is correct for the sale, the buyers should proceed to the following step or they will lose that deposit. If something is not fully legal or a physical defect that makes the property unsalable appears during the due diligence process, the party holding the deposit should released back to the buyers.

a) What documentation is checked during the due diligence process:

- Nota Simple: it states who is the owner, the description of the property and the liens on the property.

- The property can be in the name of more than one individual or in the name of a company so in the first case, all owners should agree with the sale and sign the proper documentation or for the second case, a proper official of the company should be the one signing all documentation for the sale.

- The description of the property at the Nota Simple (including and not limited to address, sizes and neighbors) has to match with what the buyer is has been told it is buying.  

- The properties are sold, in general, free of liens. If any lien appears on the Nota Simple, the seller is liable to remove it from the record of the property at the Land Registry prior to the closing (that may include mortgages, embargos, urbanistic liens, etc.)

- Planning permission: that should be checked, specially in Marbella where the planning situation is not fully clear, to see if the property complies with the planning regulations of the area/urbanization/complex. This is not an easy step and should be dealed by a an expert on this issues like a lawyer, an architect or an experience real estate agent.

- Payment of the taxes (mainly council tax—IBI—and rubbish collection) and community fees: those expenses are charged against the property and should be checked that are up to date on payments.

b) A physical check by an expert technician or an experienced real estate agent to establish if the property has any defects that can or not be corrected or, or not, compensated. In case of major defects, like serious structural damage, the deal will be broken.

What is going on with the housing prices in Marbella?

The information on the price index for the second quarter of 2016 for Marbella has been recently released by the Ministry of Housing showing the same situation we have been experiencing in, at least, the last three years that is that the prices are not showing a real upwards tendency. I honestly thought that we were going to see some increases but it is not the case for Marbella. In Estepona, things are a little bit different and a slightincrease can be observed in the curve.

To contrast the information given by the Ministry, I have checked the index price given by one of the best real estate portals in Spain, Fotocasa. What we can see is that, although the values are different which is normal because the portal works with “for sale” properties, the tendency is about the same. I have included charts from Fotocasa for Marbella East, the Golden Mile and Nueva Andalucia. In Marbella East the prices are lower than at the end of last year, on the Golden Mile the prices went up a little at the end of 2015 but went back down during 2016 and in Nueva Andalucia they went up at the end of 2015 and are flat with a tendency down during 2016. Therefore, the same tendency as the official data: slight increases at the beginning of this year and since then flat.

To be honest, although I thought we were going to see increases in prices, I think it was more a desire for the normalization than a reality as I still can feel that the market is slow. What is true is that we are seeing active movements by developers and institutional buyers looking for land to build and opportunities in the market but the flow of final buyers is still slow.
