Local News: The Transfer Tax in Andalucia has definitively been reduced.

The Junta de Andalucía passed a Law, 5/2021, on October 20th, 2021 affecting some of the taxes applicable to the Andalucía region. The Transfer Tax applicable when buying a home was one of the taxes affected by those changes which came into force January 1st, 2022. These are the details of those changes:

- The general tax rate has been fixed on a flat 7% (versus the previous 8%, 9% and 10%) for the purchase of second hand properties. This reduction was previously approved in April 2021, but only for the year 2021, and has now been adopted permanently.

- There are also some cases with reduced tax rates as follows:

  • A reduced tax rate of 3,5% for buyers younger than 35 years, numerous families and handicapped purchasers with a maximum home value of 150.000 € for young buyers and 250.000 € for the last two groups. This reduced rate with a maximum home value of 150.000 € is also applicable to victims of domestic violence, victims of terrorism and to properties located in municipalities with depopulation problems.

  • A reduced tax rate of 6% for sales where the home is going to be the permanent resident of the buyer and the price of the home does not exceed 150.000 €.

  • A reduced tax rate of 2% when the purchase party is a company registered as a real estate company complying with some specific regulations.

* Always remember that the Transfer Tax is applicable only on the purchase of second hand properties while VAT applies to the purchase of new homes where the flat rate is 10%.

** Since every case is different, please check the contents of this article with your lawyer or tax advisor.

The Transfer Tax has been reduced to a unique fix rate of 7%

On April 27, the Junta de Andalucia announced the approval of a new Decree for the reduction of some tax rates in Andalucia with the idea of reactivating the economy of the region. Among this new measurements, there is one that affects directly, and extremely positive, the real estate market, one of the sectors they are trying to promote, that is the reduction on the rate on the Transfer Tax applicable to all purchases of properties in Andalucia.

The Decree establishes that the actual rates of 8% (for purchases up to 400.000 €), 9% (on top of 400.000 € and up to 700.000 €) and 10% (for the excess on top of 700.000 €) will be reduced to a unique general rate of 7%. For example, on a purchase of a 1.000.000 € property, the Transfer Tax was previously 89.000 € and has been reduced to 70.000 €. That is a 21% reduction on the Tax.

Additionally, there is a reduction on the Stamp Duty Tax from 1,5% to 1,2% that affects mainly to the purchase of new units.

The only not-so-positive could be that this new regulation is going to be in place only to December 31st, 2020 although we hope that it will be extended further. In any case, it is a really good opportunity for those buyers that may want to take advantage of this reduction in the Tax before the end of the year.

Saving tip on the Energy Efficiency Certificate if you use your property less than four months a year

Double-click to edit...

The answer on the question if it is compulsory to have the energy efficiency certificate to sell or rent a property is Spain is yes. It was included in the Royal Decree (Real Decreto) 235/2013 that in is Article 2.1 established that not only every new property build requires that energy efficiency certificate but also those properties that are for sale and rent.

However, there is an exception included in Article 2.2 that can be applied those properties that are used less than four months a year. The letter g) of that article says in Spanish (non official translation below):

“Buildings or part of housing buildings which use is less than four months a year or otherwise for limited periods within a year and with an estimated consumption of energy lower than 25 % of the total consumption usage for a year. That circumstance has to be stated in a formal statement by the owner of the property”.

Therefore, if the property is occupied less than four months in a year, the owner can sign a formal statement invoking that 2.2.g article and stating that the property is being used less than four months a year. That way the owner does not need the energy efficiency certificate to sell or rent and can save the cost of it. When renting the property, the same criteria applies that is that the total yearly usage has to be less than four months a year.

I have been using that formal statement (declaracion responsable in Spanish) for more than six years now to sell properties in the area of Marbella and Benahavis when a property fulfills the requirements and have never had problems when closing at Notary where the Notary will ask for the energy efficiency certificate or equivalent document to comply with the above mentioned Decree 235/2013. It is true that I have been asked more than once how can be proved that the property is used less than four months in a year and the question has been asked a couple of times by Notaries stating that the only requirement of the law is the statement signed by the owner. If that statement is false, the only liability would be on the owner.

* Since every case is different, if you have to sign a for sale deed where the energy efficiency certificate is compulsory, please check the different options and/or documents with your lawyer or notary prior to the signature.

Double-click to edit...

Legal Changes: Long Term Rentals

The legal measures established by the new rental Law 07/2019, passed on March 1, greatly modify the regulation of the rental market trying to give more security and stability to the tenants of primary residences in those rental contracts signed from March 6, 2019 equaling the legal positions of the owner and the tenant in the rental relation.

Prior to comment the main changes introduced by this new Law and considering the real estate market of the Costa del Sol, it is important to emphasize that this new regulation will not be applied to those properties with a built area higher than 300 square meters or to those contracts where the yearly rent is higher than 5,5 times the minimum annual interprofessional salary. In these cases, the rental contracts will be governed by the will of the parties.

Once this clarification is done, it is important to point out that the duration of the rental contracts, although it can be agreed between the parties in those cases when the period is shorter than five years, or seven years in the case the landlord is a company, will be mandatorily extended per annual periods until it reaches a minimum duration of five years, or seven in the case the landlord is a company. This circumstance gives more tranquility to the tenants who additionally, if that is agreed with the landlord, extend the contracts for a maximum of three more years.

In the same line, the new law solves clearly the legal consequences of a possible sale of a property. In these cases, the tenants will maintain their rights to live in the property for the agreed period even if the property is sold by the landlord. There is no need anymore to register their rights at the Land Registry to maintain them.

On the other hand, and in relation with the owners after this reform of the law, it is important to emphasize that the recovery of the property by means of an anticipated cancellation of the rental contract has to be expressly detailed in the rental contract in order to be able to enforce that recovery (in case the property is needed as primary residence for the owner, its children, etc). Furthermore, the new law allows the landlord to request additional guarantees to the deposit, not exceeding two times the monthly rent, improving its position in front of the tenants.

Finally, and contrary to the habitual practice in the real estate market, it is important to point out that the formalization of eleven months rental contracts to try to avoid the spirit of this law is being considered by the courts as fraud of the law if the tenant can prove that has its habitual and effective residence in that property. The rental contracts with a limited duration should be only used in those cases when the tenant has a housing need for a closed period of time and a certain motive that has to be clearly established in the rental agreement.

Changes in property laws: Short Term Turistic Rentals

In the last years and with the outcome of the new online platforms dedicated to it, the new modality of short term touristic rentals has come to the market with extraordinary force. It is a touristic rental for short periods of time, even days. There has been always a rental of properties that has been called short term rental or holiday rentals but the simplicity that the new online platforms brought to the market in order to manage those short term rentals has changed the rental market. In fact, these new type of rentals are regulated under the “Properties for Touristic Use” heading.

In general, there is nothing to say to this new modality of rentals as every owner can and should do whatever he/she wants with his/her property: use it, keep it empty, rent for long or short term. However, this new rental type for short periods of time for, in general, holiday use has brought in many cases inconveniences, in many cases important ones, for the rest of the neighbors living in the same complex. The simple fact that those are short term rentals creates constant noises (luggage carrying), loss of security (lots of external people have access to keys of properties and common areas), properties controlled by third parties, dirt, etc. Additionally, the renters are people on vacation with different time tables and behaviors than the normal long term people living in the complex (night hours activity, loud music, loud volume conversations, etc).

Up to now, neighbors were defenseless on these situations but the different administrations (local, regional and national) have become aware of the reality and are starting to legislate to control not only the Short Term Touristic Rentals but also the number of units that can be dedicated to that activity in each complex/building.

· Initially, the Regions have established regulations to authorize a property to allow this Short Term Touristic activity on it. In the case of Andalucia, it is regulated by the Decree 28/2016 of February 2nd where the conditions and basic requirements for a property to be inscribed in the Registry of Properties for Holiday Rentals of Andalucia are stipulated.

· However, the most important step on the regulation and control of these properties dedicated to short term holiday rentals was established in 2019 with the Law 7/2019 of March 1st. This Decree establishes that from March 6, 2019, the communities can limit or condition the short term touristic rentals activity with the favorable vote of 3/5 of the owners. The same Decree also establishes the non retroactivity of the norm so those properties being used for short term touristic rental with rental licenses from the Junta de Andalucia obtained before the vote of the community are not affected by the decisions limiting the rental rights by the community.

· Furthermore, based on that Decree, the communities can agree on applying special community fees to those properties being used for short term touristic rentals. The increase in the fee can not be higher than 20% of the previous fee. Once approved by the General Meeting of the community, the agreements have to be registered at the Land Registry for third parties knowledge and have to be communicated to the owners of the properties dedicated to short term touristic rentals.

The short term touristic rental activity, with its pros and cons, has arrived to stay so it is always good that new norms are approved to regulate it. A stable legal framework to work with will not only protect the tranquility of those living in complexes with properties where the short term rental activities are carried out but also give a regulation for those wanting to get into this new business opportunity.

Changes in property laws

Just a brief comment on this Newsletter to inform about three property laws that have been recently modified in Spain so, although I will have coming articles from experts on these issues commenting on them, I wanted to at least mentioned them. If someone may be affected, he may check his particular situation with a lawyer or tax advisor.

1.– Horizontal property law in short term rentals so the communities can put a veto on short term rental if a qualified majority decides so.

2.– Rentals law. There are changes on the law that regulates the rental of properties in Spain. It is worth taking a look to those changes.

3.– Mortgage law. There are also changes on the law that regulates the mortgages.

If we summarize the real estate market in the area, we can say that prices are going up, inventory is growing too much and transactions are going down. In Marbella and on second hand properties, the number of sales has been reduced in the fourth quarter by 21,2% and in Benahavis by 11,9% when compared with the same periods of 2017. If we take only Marbella, that number was also negative when comparing the third quarters of 2017 and 2018. We can see the same negative numbers in most municipalities of the Costa del Sol when looking at the fourth quarter of 2018 vs the same one of 2017. Things look bad when analyzing those numbers but the feeling in the first quarter of 2019 was relatively good.  What it is clear is that, with this extremely high inventory, that keeps on growing with all the new constructions increasing and the prices going up, only the properties with really competitive prices will be sold and that is exactly what we are seeing in this market and what we are selling.ng competition, to be able to sell it is very important to have a competitive pricing, and new developments are coming up, which will increase even more the inventory.
